The Mountaineers Foundation (“Foundation,” “us,” “we,” or “our”), also known as the Keta Legacy Foundation, owns and operates this website. This privacy policy (“Privacy Policy”) describes the privacy practices that the Foundation follows when collecting and using information about you from the Foundation’s website Keta Legacy Foundation (located at https://ketalegacy.org) (the “Website”). By accessing or using the Website, you agree to be bound by this Privacy Policy as posted at the time of your access or use.

We collect data to ease your navigation on the Website, communicate with you, and improve our programming. Some of this information is provided by you directly. Some of the information is collected through your interactions with the Website. Forms

We use analytics providers to collect information about Website usage and the visitors to our Website. The analytics providers use Cookies in order to collect usage information from users that visit the Website, including time spent on the Website pages, operating system, and Internet Protocol (“IP”) address.

Service Providers

We may use third-party service providers to assist us in the operation, management, improvement, research, and analysis of the Website (“Website Vendors”). Some of our Website Vendors collect information from you on our behalf. Information you provide may be subject to the Website Vendor’s privacy policy.

Currently the Foundation uses PayPal and Square as our Website Vendors for processing online donations. Information collected by PayPal or Square is used to record online donors and receive payment in the amount of their gift(s). We may use PayPal or Square information to send acknowledgements to donors of our receipt and appreciation for their donation.

If you subscribe to our newsletter, the Foundation uses a Website Vendor for marketing (e.g. Mailchimp) to collect your subscriber email address and contact information.

With Whom We Share Your Data

Except in the circumstances described in this Privacy Policy, the Foundation will not share your personally-identifying information with anyone.

We may share your data with our Website Vendors assisting us in the operation, management, improvement, research and analysis of the Website. For example, form entries may be checked through an automated spam detection service.

We may share your information with your consent. For example, when you donate to the Foundation you have the option to make your donation anonymous. If you do not take that option, you are consenting to the public display of your donation information (such as name or comment).

We may also share your personally-identifying information if required by law or court order

The Foundation will not rent or sell personally-identifying information to anyone, ever.

Finally, if we should ever transfer or restructure the operational ownership of the Foundation, such as through a merger with another entity or a reorganization of all or a part of our operational responsibilities or assets, we may disclose, transfer, assign our rights, and/or delegate our duties to your personally identifiable information without notice and consent, including to prospective or actual recipient entities. Should this occur, we will require any third party receiving your personally identifiable information under this subsection to be contractually required to provide the same level of privacy compliance as provided by us under this Privacy Policy.

What Options You Have Relating To Your Data

Unless otherwise requested under this Privacy Policy, we may retain your personal information indefinitely, or as long as legally required or allowed.

You can always refuse to supply personally-identifying information on the Website, with the caveat that it may prevent you from engaging in certain Website-related activities, such as making a donation or applying for a grant through the Website.

If you receive our electronic newsletter communications, you may contact us if you no longer want to be contacted via email. Email communications you receive from us will generally provide an unsubscribe link allowing you to opt out of receiving future email or to change your contact preferences. Please note that even if you opt out of our newsletter updates, we may still send you information regarding your form submissions, such as a response to a grant application or a donation receipt. We may also keep certain limited information about you so that we may honor your request.

If you make a donation or apply for a grant on the Website, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you, although any such request is subject to any obligations we have to keep data for administrative, legal, or security purposes.

How We Protect Your Data

The Website uses Secure Sockets Layer (“SSL”) technology to establish an encrypted connection between our web server and your browser. This connection helps to ensure that data passed between server and browser remains private and integral. SSL is an industry standard and is used by millions of websites in the protection of their online transactions with their customers.

Additionally, we use several security methods to reduce the risk of data breach. That said, no website or database is hack-proof. Any information you submit to us via a form on the Website could potentially be compromised if the Website’s security is breached.

Please note that donations are processed through a Website Vendor (currently, PayPal or Square). The Website does not receive, collect, or store the payment information (bank account/credit card information) PayPal or Square uses to process donation payments.

Information gathered from forms or third parties are safeguarded by being stored in password-protected databases, including our CRM and our financial records. Passwords are revoked when staff and Directors leave the Foundation. All staff and Directors are expected to protect the privacy of our volunteers, donors, and applicants.

CHANGES TO THIS PRIVACY POLICY

Because our privacy practices and privacy law necessarily evolve over time, we reserve the right to update this Privacy Policy from time to time in our sole discretion, upon notice to you, such as by posting an updated version of the Privacy Policy on the Website. You should periodically review this Privacy Policy to ensure that you are familiar with the most current version. Your continued use of the Website after the Effective Date posted below will constitute your acceptance of the updated Privacy Policy.

At this time, the Foundation is not subject to the requirements of the California Consumer Privacy Act. We will revise this Privacy Policy when necessary to comply with the requirements of that statute, or similar federal or state laws that may be enacted in the future.
